General terms and conditions for online sales


GENERAL
The general terms and conditions of sale apply to all services and products (tickets) of the "ski lift" department of Téléovronnaz SA.
For the Magic Pas, the ad hoc conditions apply (www.magicpass.ch).
If Téléovronnaz SA does not provide its services in connection with the sale of tickets or the use of the facilities, either in whole or in part, either permanently or temporarily, the customer shall have no claim against Téléovronnaz SA (in particular no claim for restitution or damages). This rule applies in particular to interruptions or limitations of the operation of the ski lifts as well as to closures of ski runs in the following circumstances:
- Acts of God,
- Force majeure such as wind or weather conditions, avalanche danger, strike,
- Orders or restrictions from an authority (e.g. due to a lack of electricity),
- Voluntary restrictions due to special circumstances (e.g. due to a call from the authorities to save money due to a shortage of electricity)
- Pandemic or epidemic


1. TICKETS AND SUBSCRIPTIONS
1.1. Prices
The prices of the subscriptions are degressive. In return for this reduction, the client assumes the risks of deterioration in weather conditions which may reduce access to the slopes. Téléovronnaz SA does not make any refunds in the event of closure of its facilities due to reasons beyond its control.
1.2. Validity
All tickets and passes are personal, non-transferable and non-refundable. They are only valid during the normal published operating hours.
The validity of 5-day ski passes is limited to the winter season in which they were purchased.
1.3 Loss or theft
In the event of loss or theft of a ticket or season ticket, it will be replaced only once and only on presentation of the purchase receipt. A processing fee of Fr 20.00 will be charged for the replacement card, plus the cost of a new keycard (Fr 3.00).
1.4 Refunds
Subscriptions are not refundable under any circumstances (illness, accident, bad weather, closure of facilities, etc.). It is possible (optional) to take out insurance with our funds. If the subscription is insured, it is the insurance company (Solid Insurance) that processes the claims according to its own general conditions (www.skicare.ch).

Ski pass on keycard only (hands-free support). Chip card Fr 3.- non-refundable but reusable.


2. FRAUD AND OFFENCES
Tickets are personal, non-transferable and non-refundable. In the event of non-compliance with the general conditions, in addition to the full fare, a surcharge of Fr 200 will be applied. The holder is responsible for keeping his/her ticket in such a way as to avoid its misuse by third parties, including members of his/her family or entourage.
2.1. Misuse
In the event of misuse of a ticket by a third party, and subject to cases of theft, loss or exchange between legitimate holders demonstrated by the holder and/or user concerned, the ticket used by a third party will be cancelled without replacement; this is without prejudice to the surcharge applicable to the holder and user.
In the event of an allegation that a ticket has been stolen or borrowed against the will of the holder, Téléovronnaz SA reserves the right to link the replacement to the filing of a criminal complaint against the user.
2.2 Checks
Ticket checks may be carried out at each installation. The season ticket, together with an identity document, must be presented at all checks carried out by our staff or by the inspection company appointed by Téléovronnaz SA.
2.3 Photo and video surveillance
In order to confound fraudsters, a photo of each smart card user is taken automatically at the first daily pass through the control gate, as well as at random times later in the day. By comparing the photos, Téléovronnaz SA is able to detect fraud in the case of ticket transfers, a practice that is strictly forbidden by our general terms and conditions. Our photo database is only accessible to our security service during the validity period of the passes and for the purpose of identifying fraudsters.


3. EXCLUSION FROM TRANSPORT
3.1 General
Persons may be excluded from carriage if :
- They are intoxicated or under the influence of drugs; - They behave inappropriately
- They behave in an inappropriate manner;
- They do not observe the regulations on the use of the means of transport and/or do not comply with the orders of Téléovronnaz SA staff.
3.2 Transport for winter sports
If the weather conditions are unfavourable, in particular in the event of avalanche danger, transport for the purpose of sports may be prohibited.
In addition, persons may be excluded from winter sports transport if their behaviour endangers third parties. In the event of a repeat offence or in serious cases, the ticket or season ticket may be confiscated.
A person is considered to be endangering third parties if he or she
- Has behaved in an indelicate manner;
- has travelled on a slope exposed to the danger of avalanches;
- Failed to obey signs and prohibitions;
- Opposed the instructions of the avalanche control and rescue service.


4. LIABILITY
The responsibility of the lift company is limited to negligent and intentional behaviour, as far as this is permitted.


5. RESCUE SERVICE
In the event of an accident on the Téléovronnaz SA domain and recourse to the rescue service, a minimum amount of Fr 270.00, not including material costs, will be charged to the injured customer. The costs of third parties (e.g. air rescue, doctor, ...) shall be borne directly by the client. Any claims for reimbursement must be submitted by the client to his insurance company. In the event of an accident outside the marked and open slopes, the amount charged will be higher and will, in any case, cover the entire costs incurred.


6. APPLICABLE LAW / PLACE OF JURISDICTION
The contract between the client and Téléovronnaz SA is subject to Swiss law.
The place of jurisdiction is Leytron.
